New energy performance certificate requirements for 2025: what you need to know before selling

The European energy efficiency in buildings regulation introduces stricter obligations in 2025 that affect all sales and mortgages on residential properties in Spain.

The European Energy Performance of Buildings Directive (EPBD, revised in 2024) requires Spain to transpose a series of measures that enter into force progressively throughout 2025. The main changes for notarial transactions are as follows.\n\nCertificate required for all property sales\n\nFrom 1 January 2025, it is not possible to sign a public deed for the sale of a dwelling without the seller providing a valid energy performance certificate (with the rating stated in the deed). The notary is required to record the rating in the public document and to inform the buyer.\n\nNew validity periods\n\nThe energy performance certificate now has a maximum validity of eight years (previously ten). Certificates issued before 1 January 2017 have automatically expired.\n\nImplications for green mortgages\n\nBonified mortgage loans (green mortgages) offered by banks from 2025 onwards require a minimum "C" rating. We recommend requesting the certificate well in advance (at least four weeks) to avoid delays in closing the transaction.
