Real estate transactions
Yes. In Spain, a notarial public deed is an essential requirement for the transaction to be registered at the Land Registry and to have full legal effect against third parties. Without a public deed, the property cannot be considered fully transferred in legal terms.
Notarial fees are regulated by the state-set notarial tariff and depend primarily on the purchase price. As a guide, for a property at €300,000, notarial fees run approximately €800–€1,100. Our office always provides a no-obligation quote in advance.
As a buyer you will need: a valid ID or passport, NIE if you are a foreigner, proof of payment method (bank certificate or transfer), and if applicable a land registry extract. As a seller: title deed, latest property tax receipt, community of owners certificate and, where applicable, the energy performance certificate. Our team will send you a personalised checklist upon confirming your appointment.
Wills & inheritance
It is never too early. A will can be amended or revoked at any time as long as the testator retains full capacity. Doing so in advance allows calm reflection and avoids later incapacity. We recommend reviewing it every five years or after a significant life event (marriage, birth of children, divorce, acquisition of major assets).
In Spain there is no strict legal limitation period for accepting or renouncing an inheritance, but there is a six-month deadline from the date of death to settle Inheritance and Gift Tax (extendable by a further six months upon request). Late acceptance can incur surcharges and interest, so we recommend initiating proceedings as soon as possible.
